These Terms and Conditions ("Terms") govern your access to and use of the Biblewhere website, platform, applications, and services (collectively, the "Service"), operated by Carta Digital Ltd., an authorized partner and exclusive digital licensee of Carta Jerusalem. (For the purposes of these Terms, "Carta," "we," "us," or "our" refers to Carta Digital Ltd., though certain rights and protections herein extend to Carta Jerusalem as the licensor of the Content).

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

The Service is intended for users aged 18 and above. Minors may use the Service only with the consent and supervision of a parent or legal guardian.

2. Accounts and Registration

Access to the Service requires the creation of a user account. You agree to provide accurate, current, and complete information.

Device Limit: A single user subscription allows for access on up to 4 (four) separate devices.
Security: You are responsible for maintaining the confidentiality of your credentials.

3. Subscriptions, Payments, and Renewals

Biblewhere is a subscription-based service.

Billing: Subscriptions are billed in advance on a recurring basis and renew automatically unless cancelled.
Refunds: Refunds are granted at the sole discretion of Carta, unless otherwise required by applicable local consumer protection laws (e.g., EU/UK statutory right of withdrawal).
Changes: Prices and features may change; such changes will apply prospectively to your next billing cycle.

4. License and Permitted Use

4.1 Personal License

Subject to these Terms, Carta grants you a limited, non-exclusive, non-transferable, revocable license to access the Service for your private, personal, non-commercial use.

4.2 Permitted Educational and Ministry Use ("Fair Use" Policy)

To support the study and teaching of biblical history, Carta defines the following as permitted "Fair Use" without requiring further written consent, provided the use is non-commercial and includes clear attribution:

Live Teaching: Displaying maps or content during a live, in-person, or virtual classroom, lecture, or religious service.
Study Materials: Including content excerpts in printed handouts for small-group study (up to a limit of 50 physical copies).
Attribution Requirement: The Biblewhere/Carta watermark and copyright notice must remain visible and unaltered.

Important: Any use beyond these specific parameters--including digital publication, commercial distribution, or large-scale reproduction--does not qualify as "Fair Use" under these Terms and requires prior written permission from Carta.

5. Prohibited Uses

You agree not to:

Share account credentials beyond the 4-device limit.
Circumvent security, access controls, or technical protections.
Scrape, crawl, or harvest data or content via automated or manual means.
Use the Service for any unlawful or misleading purposes.

6. Intellectual Property Rights

All content available on the Service--including but not limited to maps, texts, and images--is the exclusive property of Carta Jerusalem and/or its licensors. This content is provided to you by Carta Digital Ltd. under an exclusive licensing agreement. All rights not expressly granted are strictly reserved.

7. Artificial Intelligence - Use and Limitations

7.1 AI-Assisted Content Disclaimer

Not Definitive: AI-assisted content may contain inaccuracies or interpretive limitations.
No Theological Authority: Such content does not replace scholarly research or primary sources and should not be relied upon as definitive theological, historical, or academic doctrine without independent verification.

7.2 Prohibition on AI Training and Model Use

Except with express prior written consent, you are strictly prohibited from using any content from the Service for:

Training, fine-tuning, or validating artificial intelligence systems or Large Language Models (LLMs).
Feeding or ingesting content into automated generative systems for any purpose.

8. Downloads

Where the Service permits the downloading of digital content (e.g., PDF maps):

Perpetual Personal License: You are granted a license to keep and view the downloaded file for your private, personal use indefinitely.
No Transfer of Ownership: Ownership of the underlying copyright remains with the original rights holder (Carta Jerusalem Ltd.). You may not resell, redistribute, or upload these files to public websites or AI training repositories.

9. Analytics and Privacy

We collect limited usage and behavioral data to maintain and improve the Service. We do not sell personal data. All data processing is governed by our Privacy Policy, which forms an integral part of these Terms.

10. Third-Party Services

The Service may rely on third-party providers (e.g., payment processors, hosting). Carta is not responsible for the acts or omissions of such providers.

11. Suspension and Termination

Carta reserves the right to suspend or terminate access to the Service at any time, without notice, if we reasonably believe you have violated these Terms.

12. Disclaimer of Warranties

The Service and all content are provided "as is" and "as available". Carta does not warrant that the Service will be uninterrupted, error-free, or that AI-generated summaries will be 100% accurate.

13. Limitation of Liability

To the maximum extent permitted by law, Carta Digital Ltd.'s total liability for any claim shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim. In no event shall Carta Jerusalem Ltd. be liable for any claims arising from the technical operation of the Service by Carta Digital Ltd.

14. Indemnification

You agree to indemnify and hold harmless Carta and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Jerusalem, Israel.

16. Changes to the Terms

Carta may modify these Terms from time to time. We will notify users of material changes via the Service or email. Continued use of the Service constitutes acceptance of the revised Terms.
